Waiver of Liability and Assumption of Risk Agreement

By signing below, you acknowledge that you have read, understood, and agree to the terms, policies and conditions set forth in this release and waiver of liability before participating, or allowing your child to participate, in any activities provided by Gotcha Gymnastics LLC (“the Company”).

Assumption of Risks:

I understand and acknowledge that participating in gymnastics activities involves inherent risks, including but not limited to injury and illness, including communicable diseases such as MRSA, influenza, and COVID-19. These risks can result in serious injuries, permanent disability, or death. While rules, equipment, and discipline may reduce these risks, they cannot eliminate them entirely. FOR MYSELF, SPOUSE, AND/OR CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF GOTCHA GYMNASTICS LLC or others, and I take full responsibility for my or my child’s participation.

Release of Liability:

I, as the participant or as the parent/legal guardian of [Child/Participant listed], hereby waive, release, and discharge Gotcha Gymnastics LLC, its owners, employees, agents, and representatives from any and all claims, liabilities, damages, or demands arising out of or in connection with my or my child’s participation in any gymnastics activities provided by the Company, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE. I, on behalf of myself and/or my child, HEREBY RELEASE AND HOLD HARMLESS Gotcha Gymnastics LLC, its directors, officers, agents, employees, volunteers, other participants, and if applicable, owners and lessors of premises used to conduct the activities, WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to property resulting from participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF GOTCHA GYMNASTICS LLC OR OTHERWISE —except for claims arising from gross negligence or willful misconduct, to the fullest extent permitted by law. I further agree to INDEMNIFY AND HOLD HARMLESS all the above Releasees from any liabilities incident to my or my child’s participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.

Private Lesson Release: I understand that (if applicable) for private lessons at my home or another off-site location, I am responsible for providing a safe environment for the participant and instructor. Gotcha Gymnastics LLC is not responsible for any injury, illness, or damage. The standard release and waiver of liability still applies.

Virtual Lesson Release, I understand that participation in virtual lessons carries a risk of injury. I agree to supervise my child, ensure a safe practice area, and release Gotcha Gymnastics LLC and its instructors from any liability.

Medical Authorization (if applicable): If I am signing on behalf of my child, I give permission for the owners, officers, employees, and/or agents of Gotcha Gymnastics LLC to seek emergency medical treatment for my child if I cannot be reached. I agree that I will be responsible for any costs incurred for such emergency medical care.

Social Media Clause: I understand and agree that during my or my child’s participation in gymnastics activities provided by Gotcha Gymnastics LLC, we may be photographed, videotaped, or otherwise recorded. I grant the Company permission to use such photographs, videos, or recordings for promotional purposes on its website, social media channels, or other marketing materials. I waive any rights to compensation or ownership of such materials. These will be used for Gotcha Gymnastics purposes only and will not be shared with or sold to third parties.

Policy Agreement:

Additionally, I understand:

1. Medical Clearance Policy: To ensure the safety and well-being of all participants, Gotcha Gymnastics reserves the right, at our discretion, to require medical clearance for individuals with specific medical conditions or support needs before attending our classes. This policy helps us maintain a safe and inclusive environment for everyone.

2. I understand anyone accompanying the participant who enters the gymnastics area does so at their own risk. The Release & Waiver apply, & Gotcha Gymnastics isn't responsible for injury, illness, loss.

3. Positive Behavior & Safety Policy: At Gotcha Gymnastics, safety is our top priority. Gymnastics involves physical activity that requires focus, discipline, and awareness of one’s surroundings. To ensure every child’s safety and enjoyment, we have implemented the following behavior & safety policy:

   1. Verbal Warning: If a child is not following instructions or behaving in a way that could jeopardize their safety or the safety of others, they will first receive a verbal warning.

   2. 2-Minute Break: If the behavior continues, the child will be asked to take a 2-minute break from activities to reflect on their actions and calm down.

   3. Removal from Class: For continued disruptive or unsafe behavior after the break, the child will be respectfully removed from the class for the remainder of the session. Please note, in this case, no refund will be issued

   4. Attire: Wear comfortable gymnastics clothing (leotard or athletic wear), hair pulled back, away from face, no loose fitting clothes, buttons, claw clips, hard headbands, or jewelry.

Acknowledgement: I, FOR MYSELF, AND ON BEHALF OF MY CHILD (IF APPLICABLE), HAVE READ THIS RELEASE OF LIABILITY, ASSUMPTION OF RISK AGREEMENT, AND ALL THE OUTLINED POLICIES AND FULLY UNDERSTAND, AGREE TO ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
